Terms of Service

These terms are an agreement between you and Brainforest AI (“Brainforest”, “we”) for using brain-forest.ai. By creating an account you agree to them. If you use Brainforest for a company, you confirm you can agree on its behalf.

The service

Brainforest researches your brand and generates ad images, videos and copy with AI models. Output is generated automatically and can contain mistakes. Review every ad before you publish it.

Your content and your ads

• You keep ownership of what you give us (your website content, product photos, logos, brand assets).
• You give us permission to use it only to provide the service to you.
• As between you and us, you own the ads we generate for you and can use them however you like.
• You confirm you have the right to the materials you provide, including any trademarks and product images.

Your responsibilities

• You are responsible for the ads you run, including that their claims are true and that they follow the law and the ad platform’s policies.
• For regulated categories (for example health, supplements, financial products, alcohol or cannabis) you are responsible for required disclosures and approvals. Our compliance flags help but are not legal review.
• Keep your login secure. You are responsible for activity on your account.

Acceptable use

Don’t use Brainforest to:

• make ads for a brand you don’t represent, or impersonate a person or company;
• create deceptive, hateful, sexual or otherwise unlawful content;
• infringe someone else’s intellectual property or privacy;
• attack, overload, scrape or reverse-engineer the service, or get around plan limits.

We may suspend accounts that break these rules.

Plans, billing and limits

The free trial includes one batch. Paid plans are billed in advance through Stripe, monthly or annually, and renew automatically until you cancel. You can cancel any time from your Account page; you keep access until the end of the period you paid for. Fees are non-refundable except where the law requires otherwise. Each plan includes a monthly allowance of batches, videos and edits, shown on your Account page. We’ll give notice before changing prices.

Availability

We work to keep Brainforest running, but it’s provided “as is” without warranties of any kind, including that it will be uninterrupted, error-free, or that ads will perform.

Liability

To the extent the law allows, Brainforest is not liable for indirect or consequential losses (such as lost profits or ad spend), and our total liability for any claim is limited to what you paid us in the 12 months before it arose.

Ending the agreement

You can stop using Brainforest and delete your account at any time. We may end or suspend access for a serious breach of these terms. Sections about ownership, responsibility and liability survive.

General
